Policy Changes
We reserve the right to change, modify, add or remove portions of this policy at any time, and any changes will become effective immediately upon being posted unless stated otherwise. This policy was updated on January 19, 2007.
Indemnification
The client represents that it has the legal right to produce all printed materials ordered from Blossom-Publishing.com, the ecommerce division of Blossom Publishing and W&C Printing Company, Inc. In the event that a charge, claim or demand, or arbitration, action or proceeding (collectively, a "Claim") is made or commenced against W&C Printing Company Inc. based upon, relating to or arising from the alleged wrongful acts of the customers, or alleging that the printing performed or product produced by W&C Printing Company Inc. ordered by the client: (a.) infringes any copyright, patent or other proprietary right of any person; or (b.) contains matter that is libelous, slanderous, defamatory, scandalous or obscene, the client shall indemnify and hold W&C Printing Company Inc. harmless from and against any loss, damages, cost and expense arising from or related to the claim including without limitation; (1.) defending W&C Printing Company Inc. against any such claim (2.) paying any judgment or award against the third party or client; and (3.) reimbursing W&C Printing Company Inc. for any legal fees and expenses it reasonably incurs in responding.
Liability
W&C Printing Company Inc. liability shall be limited to the cash received from the client for any defective goods, and shall in no event include special, consequential, incidental, indirect or similar damages, including without limitation, lost profits. W&C Printing Company Inc. warrants that every product manufactured by it meets industry standard for such product and is free of any material defect in workmanship. IT IS EXPRESSLY AGREED THAT THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF FITNESS FOR PARTICULAR USE AND MERCHANTABILITY. W&C Printing Company Inc. makes no other warranty and no actions or words of W&C Printing Company Inc. or its officers, employees or agents shall constitute a warranty. As the client you are required to use the proofing function within your operation to protect yourself from ERRORS and OMISSIONS.
Payment/Billing
Due to our rapid turnaround and production schedules, all orders must be prepaid before the proof is started, unless an alternative arrangement has been made with the accounting agents of W&C Printing Company, Inc.. Your credit card bill will read "Blossom Publishing".
Samples Permission
Unless you expressly forbid it, by placing an order with Blossom-Publishing.com you agree that the printed materials produced may be used online as a sample or distributed as samples or for advertising purposes. No compensation will be paid with respect to the use of your sample.
Right to Subcontract
We reserve the right to assign any portion of the work required to another contractor.
Disputes & Venue
For legal purposes, the venue for any dispute shall be Winona, Minnesota, USA.
Electronic Manuscripts/Elements
It is the client's responsibility to maintain a copy of the original computer files, artwork and transparencies. We are not responsible for accidental loss or damage to media supplied by the client or for errors on supplied artwork furnished by the client. Until we can evaluate digital input, no claims or promises are made about our ability to work with jobs submitted in digital format, and no liability is assumed for problems that may arise. Any additional translating, editing, or programming needed to utilize client-supplied files will be within the current rates published on the site unless we state differently at the start of the job. We do not archive your work for longer than it takes to produce the final product.
Stock Photography Usage
Stock photography provided by Blossom-Publishing.com is licensed to Blossom-Publishing.com, a division of W&C Printing Company, Inc., for the expressed purpose of inclusion in Print Ready Plus printed products. Blossom-Publishing.com may not transfer title to the images, or any intellectual property rights therein, to you, the customer. We may not redistribute or sell the content. On request, we are able to provide you with the image number and stock provider in the event you wish to purchase the use of said image in future materials not produced by Blossom-Publishing.com.
Quotations & Estimates
All Print Ready Plus prices include: color scanning (no photo limit), digital file preparation, typesetting and design, color proofing, reasonable customer alterations, printing, bindery and packaging. Though reasonable alterations are free, we reserve the right to charge at standard graphic design rates when the number of alterations becomes excessive. We will expend every effort to avoid alteration charges through a thorough discussion of your design parameters.
All Press Ready prices include: file preflighting, color proofing, printing, bindery and packaging.
Taxes will be charged as applicable.
Right of Refusal
We reserve the right to use our sole discretion in refusing to print anything improper or known to be illegal. We are not liable for any damages resulting from unwitting violation of copyright laws or illegal use of trade names or slogans. The client guarantees the legal title of all matter submitted to us for printing and/or publication.
Delivery
Charges for delivery of materials and supplies from the client or the client's supplier to us are not included in the price. We are responsible for damage incurred during shipping. Title for finished work passes to the customer upon delivery at the receiving location or the post office. The client must make claims for defects, damages, or shortages no later than 3 days after receipt of materials or we will assume the job has been accepted.
Overruns/Underruns
We will normally deliver the exact quantity of goods ordered plus a small additional amount, at no extra charge.
Cancellations
We understand that occasionally the need arises to cancel an order, however, we may require compensation for incurred costs and related obligations at the time of cancellation. Due to the speed of our turnaround, the client may only cancel a job, at no cost, on the same business day the order is placed.
Workmanship Guarantee
You can order from Blossom-Publishing.com RISK FREE! We guarantee you will love your printed project or we will reprint or refund at your option.
Proofing and Approval
All projects will require the customer to sign-off or approve an online PDF proof. On request, we will expedite a high resolution Epson proof, color managed and calibrated to our offset printing equipment, at no extra charge.
Blossom-Publishing.com, Blossom Publishing and W&C Printing Company, Inc. assume no responsibility for undetected production errors if:
• Proofs are waived by the client;
• The work is printed per the client's written approval;
• Requests for changes are communicated verbally.
All requests for changes of any kind should be made in writing or via email. As our objective is to build solid relationships with our customers, in the event a mistake happens we will reconcile it to your satisfaction.
Alterations/Corrections
Client alterations to Print Ready Plus artwork must be specified in writing and must include all corrections or changes from the original specifications. Though reasonable alterations are at no extra charge, we reserve the right to charge at standard graphic design rates when the number of alterations becomes excessive. We will expend every effort to avoid alteration charges through a thorough discussion of your design parameters.
